Introduction
The website localgoods.gr (hereinafter the "Website") was created and is managed by the company "LocalGoods MONOPROSOPI I.K.E.", registered with GEMI No. 186439403000 and VAT No. 802968922, headquartered in Acharnai, Attica, at 75 Megalou Alexandrou Street, 13671 (hereinafter "LocalGoods", "we", "us", "our"), and constitutes an online platform that connects its users with producers of agricultural products (hereinafter the "Products") from all over Greece, enabling them to order and purchase the Products they desire directly from the producer, without intermediaries. This document (hereinafter the "Terms of Use") constitutes a binding agreement encompassing all terms and conditions governing the relationship between LocalGoods and you (hereinafter the "User", "you", "your") with respect to your browsing of the Website and your use of the services provided. These Terms of Use apply in full and in their entirety to the use of the mobile application "LocalGoods App", available to Users via Google Play and the App Store. Wherever these Terms of Use refer to "Website", this shall be understood to also include the aforementioned application. Please read these Terms of Use carefully, along with the Privacy Policy, before using the Website. By registering on our Website and using its services, you unconditionally accept these Terms of Use and the Website's Privacy Policy, as they may be in force from time to time.
Minors
Use of the Website and our services is permitted exclusively to Users who are 18 years of age or older. By accepting the Terms of Use, the User declares that they are an adult, over 18 years of age, or, if under 18 years of age, that they have obtained the necessary consent from all those who hold parental responsibility over them and will provide their details if requested. We reserve the right to take all reasonable technical measures and to prohibit access to the Website to any User found to be in breach of this provision.
User Registration
Users wishing to access LocalGoods services must create their account on the Website by completing certain required details that will be requested for identification purposes. Registration on the Website and use of the services provided is free of charge, with no cost to the User. The User is only charged the price for the Products they order through the Website and the shipping costs for delivery, as determined each time and visible to the User when placing their order.
Services and LocalGoods' Role
The Website constitutes an online marketplace for searching, finding and connecting, through which Users can order Products sold by producers from all over Greece featured on it. Among other things, Users can purchase through the Website: honey, olive oil, pulses, pasta, flours, jams, spoon sweets, herbs, cosmetics made from natural raw materials, and other Products to be gradually added to the Website. Although LocalGoods is in no way connected with the producers, nor can it be considered in any way a seller of the Products or a contracting party in the relationship between the User (buyer) and the producer (seller), in order to ensure the highest possible quality and experience for Users and to cultivate an environment of mutual trust, all producers featured on the Website have undergone a detailed verification and certification process, including random spot checks and/or visits to their production and packaging facilities.
Ordering and Delivery of Products
Once the User has identified the Products they wish to purchase and determined the quantity, they submit their order and pay the corresponding amount directly through the Website. All payments are made using credit/debit card (VISA, Mastercard), via Google/Apple Pay, or via IRIS. The process is completed through a third-party licensed financial services provider we work with (Stripe, EveryPay), which provides all the necessary security guarantees for electronic transactions. Deliveries of Products are made through logistics companies, courier services and last-mile delivery companies partnering with LocalGoods. All deliveries will be made to the address declared by the User, or to the locker of their choice. The User must collect the Products within the notified timeframe. Upon collection of the Products, the User becomes exclusively responsible for their safety and integrity. It is expressly stated that the delivery time of the order, as determined by each producer, is indicative and not binding under any circumstances. LocalGoods does not accept any liability as a result of a delay in delivering an order to the User.
Product Returns
Every User retains the right to cancel their order before it is executed (order status: "Pending"), with no charge. The User also retains the right to exercise a withdrawal request in accordance with Law 2251/1994, as in force, and to return a Product ordered through the Website without giving any reason, within an exclusive period of fourteen (14) days from the date of receipt. The return request must be submitted by sending an email to [email protected] with the subject "WITHDRAWAL ORDER NO. XXXXXXX". When exercising the right of withdrawal, the User must send the Product back to the producer without undue delay and, in any case, within fourteen (14) calendar days of the withdrawal request. The amount will be credited to the User's card within fifteen (15) working days. Return shipping costs are borne by the User, unless otherwise expressly agreed. The right of withdrawal does not apply, exceptionally, in the cases specified in Law 2251/1994, such as: • Products that may deteriorate or expire quickly (e.g. fruit, vegetables, dairy products) • Products that have been used and/or have suffered damage and/or are not in their original condition, or are missing any accompanying documentation • Products that have been manufactured/packaged to order according to specifications set by the User In the event that a Product, upon receipt, does not match its description on the Website, is damaged, or is defective or incomplete, the User has the right to notify within five (5) days of receipt and return it within fourteen (14) days. The return request is made by sending an email to [email protected] with the subject "RETURN OF DEFECTIVE PRODUCT ORDER NO. XXXXXXX", attaching photographs clearly showing the defect. Following the return of the Product and confirmation of the defect, the Product will either be replaced and re-dispatched at no cost to the User, or the purchase price will be refunded within fifteen (15) working days. The User acknowledges that minor deviations from photographs (e.g. colour or shape of vegetables, fruits) or deviations in the final weight of the Product below 10% do not constitute a defective Product.
Acceptable Use
Users must use the Website and the services provided in a lawful and fair manner. In this context, the following are prohibited: a) Use of the Website in a way that could damage, alter or destroy the Website or prevent other Users from accessing or using it b) Use or distribution of any malicious software or harmful files capable of endangering the proper operation of the Website c) Publication or communication of any offensive, harassing, racist, pornographic, defamatory or generally unlawful content d) Communication of content they are not entitled to share, such as confidential information belonging to third parties e) Use of false, inaccurate or misleading information f) Abusive use of services, such as systematic order cancellations or false claims about defective Products g) Creation of multiple accounts with fraudulent intent h) Accessing or attempting to access other Users' accounts or their data unlawfully i) Infringement of the rights of LocalGoods, other Users or third parties j) Accessing the Website for benchmarking, copying, reverse engineering or other competitive purposes k) Use of the Website for any unlawful, unfair or immoral purpose l) Any other use contrary to these Terms of Use and applicable laws and regulations. LocalGoods reserves the right to remove any unlawful or offensive content, to suspend or permanently delete the account of any User found in breach of these Terms, without prior notice.
Reviews
Users may submit reviews on the Website regarding the producers featured and their Products. Reviews must be truthful, accurate, and based on the User's personal experience. It is strictly prohibited to post reviews that are false, misleading, abusive, defamatory or offensive. LocalGoods reserves the right to review, modify, refuse to publish or remove reviews that, in its judgment, violate these Terms of Use or applicable legislation.
Third-Party Websites
The Website may provide links to third-party websites or social media, such as those of producers featured on the Website. In no case should it be assumed that LocalGoods endorses or accepts their content, or guarantees the safety, validity and integrity of such websites. Access to and use of these websites is at the exclusive risk of the User and is subject to the terms of use and policies stated therein.
Security and Functionality
We make every effort to continuously improve the experience of Users visiting our Website. However, due to the nature of the internet, we cannot guarantee that the use of the Website will be uninterrupted, secure or error-free. In any case, LocalGoods reserves the right to temporarily or permanently suspend the operation of the Website or any part thereof for maintenance or upgrade purposes. Also, despite the security measures in place, we cannot guarantee the Website's immunity from digital viruses, malware or other harmful files. The integrity and safeguarding of each User's software systems and equipment is the User's own responsibility.
Website Content
The content of the Website and LocalGoods' services are provided to Users "as is". LocalGoods reserves the right at any time to modify, add, remove or otherwise alter the structure, content, functions and services provided on the Website, without prior notice. The information available on the Website is provided solely for the purpose of informing Users. LocalGoods makes every possible effort but does not guarantee the accuracy and validity of information posted by producers. The User is solely responsible for the trust they place in the information contained on the Website and for any decision made based on it.
Intellectual Property
The trademark "LocalGoods Η ΕΛΛΑΔΑ ΤΩΝ ΠΑΡΑΓΩΓΩΝ ΣΤΑ ΧΕΡΙΑ ΣΟΥ" is our registered trademark (filing no. OBI N293626) and enjoys full protection under applicable law. Furthermore, all content of the Website, including images, graphics, photographs, designs, texts, services provided and software, constitutes intellectual property, registered trademarks or distinctive signs of LocalGoods and is protected by applicable Greek law, European law and international conventions. The User understands and accepts that they are granted no right to reproduce, download, copy, modify, sell, resell, process or commercially exploit in any way all or part of the content of the Website, without the prior consent of LocalGoods.
Indemnification
You agree to indemnify, defend and hold harmless LocalGoods, any of our parent or subsidiary companies, our officers, directors, employees and/or partners, against any claim or demand from any third party, including reasonable legal fees, arising out of or in connection with your breach of these Terms of Use, the Privacy Policy and/or any applicable law, regulation or code of conduct.
Limitation of Liability
All producers featured on the Website have undergone a reasonable verification process regarding their reliability, production conditions and product quality. However, LocalGoods is not always in a position to investigate the completeness and validity of information posted by producers on the Website and disclaims any related liability. The listing of a producer and their Products on the Website does not constitute any promise or guarantee regarding the suitability or quality of those Products. Ordering Products through the Website is always the exclusive choice of the User. To the maximum extent permitted by law, LocalGoods expressly disclaims all liability in relation to: a) Any breach by producers of applicable legislation, health regulations or professional codes of conduct b) Any injury, damage or death connected, directly or indirectly, with Products purchased through the Website c) Any direct or indirect damage arising from the use of the Website or the Products purchased through it d) Any damage due to the User's failure to collect Products within the specified collection period e) Any damage resulting from the temporary unavailability of the Website f) Any damage, data loss or breach of confidentiality connected with use of the Website g) Any damage arising from access to third-party websites to which the Website provides links h) Any infringement of intellectual property rights by any User of the Website or third party.
Duration and Termination
These Terms of Use automatically come into force upon any User's visit to the Website, remain in force throughout the duration of access to the Website and/or use of the services provided, and constitute a fully binding legal agreement between LocalGoods and each User. LocalGoods reserves the right, at any time, without prior notice, to terminate this agreement and to suspend and/or discontinue the provision of its services to the User if it finds or reasonably suspects that the User is in breach of these Terms of Use. If a User wishes to delete their account, they may do so at any time from within their account. These Terms of Use will, however, remain in force if they continue to access the Website as a guest.
Applicable Law and Jurisdiction
These Terms of Use are governed by and construed in accordance with the laws of Greece, excluding conflict of law provisions. The competent courts for the resolution of any dispute arising between you and LocalGoods are the competent courts of Athens. As consumers, you also have the right to seek out-of-court resolution of any dispute with a producer in accordance with Regulation (EU) 524/2013. Partial Invalidity
If any provision of these Terms of Use is found to be illegal, invalid or unenforceable, that provision shall be enforceable to the maximum extent permitted by applicable law, and the invalid portion shall be deemed not to form part of these Terms of Use. This determination will not affect the validity and enforceability of the remaining provisions.
Non-Waiver
Any failure or delay on the part of LocalGoods to enforce any provision of these Terms of Use and/or to exercise any of its rights shall not be construed as a waiver of any such provision or right.
Specific Terms
In the event that the use of any service on the Website is governed by more specific terms, such terms shall be considered as forming a single whole with these Terms of Use. In the event of a conflict, the more specific terms of use of each individual service shall prevail.
Modification
LocalGoods reserves the right, at any time, to modify these Terms of Use. Continued access to and use of the Website's services shall be deemed as unconditional acceptance of such changes by the User. For this reason, Users are advised to visit this page at regular intervals during use of the services provided. The date of the last modification of the Terms of Use will always be displayed at the top of this page.
